MANILA, Philippines ? TV host Willie Revillame refuses to produce his TV5 contract in a Quezon City court, saying ABS-CBN cannot compel him to produce a document which was ?privileged? and cannot be disclosed.
In a four page opposition, the erstwhile ?Wowowee? host accused his former employers of going on a ?fishing expedition? against him to prove its P486-million counterclaim for damages.
The TV network is asking a Quezon City court to compel Revillame to show his contract with TV5, which the comedian purportedly signed after parting ways with ABS-CBN.
The opposition, filed with Judge Luisito Cortez of Regional Trial Court Branch 85, said ABS-CBN?s motion for him to produce the contract in court assumes that the document is not privileged.
?The document is a privileged matter. The documents that the motion seeks to be produced contain and provide for a non-disclosure clause, which thereby exempts it from the reach of ABS-CBN?s motion,? Revillame?s pleading said.
He added that the subject contract involves third persons, such as TV5, which are not party to the instant case, in which Revillame has asked the court affirm the termination of his ABS-CBN contract.
The TV host pointed out in his motion that he is prohibited by the non-disclosure clause to reveal the contract to any third party, including ABS-CBN, and that his erstwhile employer has no right to demand to see it.
?The documents subject of ABS-CBN?s motion has (sic) no relevance or materiality to the instance case. Consequently, the motion must be denied,? Revillame told the court.
The TV host is seeking a judicial confirmation of his decision to rescind his contract with ABS-CBN and is asking for P11 million in damages.
In reply to his civil complaint, ABS-CBN said the host violated the behavioral provisions of his contract when he threatened to resign if the network didn?t fire Jobert Sucaldito over the showbiz writer?s tirades against him.
