MANILA, Philippines?Actress Katrina Halili will ask the Court of Appeals to reverse the decision of a Pasig court dismissing the charges against suspended physician Hayden Kho in connection with videos showing them having sex that he allegedly posted on the Internet last year, her lawyer said Friday.
Raymund Palad told the Inquirer he notified the Pasig Regional Trial Court Branch 159 at noon Friday that the prosecution was appealing the case to the Court of Appeals because of errors in the findings and conclusions of the lower court.
Judge Rodolfo Bonifacio granted a motion for demurrer to evidence, saying the prosecution failed to provide sufficient evidence against Kho.
?If the notice of appeal is given due course, the case will be elevated to the Court of Appeals,? Palad told the Inquirer in a phone interview.
Palad said Halili's camp chose to file an appeal to the appellate court instead of filing a motion for reconsideration in the Pasig RTC since the actress no longer believes that Bonifacio would still rule in her favor.
?The 10 motions you plan to file in court would just come to naught if you no longer expect a reversal of decision under the same judge,? Palad said.
Halili had accused Kho of violating Republic Act 9262 or the Anti-Violence Against Women and Children Act when he allegedly took and uploaded on the Internet videos of the two of them having sex.
Halili claimed she was not aware that their sexual encounters were being videotaped by Kho.
